State of Alpha — Terms and Conditions

These Terms and Conditions ("Terms") govern your purchase and use of the coaching services and digital programs offered by State of Alpha ("State of Alpha," "we," "us," or "our") through https://www.stateofalpha.com and https://vip.stateofalpha.com (the "Website").
By purchasing a program or using the Website, you ("Client," "you," or "your") agree to these Terms.
If you do not agree, do not purchase our programs or use the Website.
Services
State of Alpha provides personalized fitness and nutrition coaching delivered as a structured coaching program. Services include individualized training guidance, nutrition guidance, and ongoing coaching support as described in your specific program. All services are coaching and digital program services.
Programs and Pricing
Programs are sold either as a one-time payment or as an installment/subscription plan. The specific price, payment structure, and program duration applicable to you will be set out at the time of purchase and/or in your coaching agreement.
Billing and Payment
For one-time purchases, the full program fee is charged at the time of enrollment. For installment or subscription plans, you authorize State of Alpha to charge the agreed amount on the agreed schedule until the total program fee is paid in full or the subscription term ends. By enrolling in an installment plan, you commit to the full program fee and agree to complete all scheduled payments. Payments are processed through our third-party payment processor. If a scheduled payment fails, we may retry the charge and may suspend access to coaching services until the account is brought current.
SMS Messaging Program
State of Alpha LLC operates an SMS messaging program to support our coaching services. By opting in through our website forms, you agree to receive automated text messages from State of Alpha LLC related to consultation booking confirmations, appointment reminders, and follow-up communications regarding your inquiry or coaching program.
Message frequency varies based on your interactions with us. Message and data rates may apply depending on your mobile carrier and plan.
You may opt out of SMS messages at any time by replying STOP to any message you receive from us. After you reply STOP, we will send one final message confirming your opt-out, and you will receive no further texts. For assistance, reply HELP to any message or contact us at [email protected].

Refund and Cancellation Policy
Because our programs involve immediate allocation of coaching resources and personalized program design, all payments are non-refundable once the program has begun, except where required by law. You may cancel future installments only under the conditions specified in your coaching agreement.
Client Responsibilities
Coaching outcomes depend substantially on your own participation, including following the guidance provided, completing check-ins, and applying the program consistently. You agree to provide accurate information about your health and circumstances and to communicate honestly with your coach.
Health Disclaimer
State of Alpha provides fitness and nutrition coaching for general wellness purposes. We are not medical providers, and our coaching does not constitute medical advice, diagnosis, or treatment. You should consult a licensed physician before beginning any fitness or nutrition program, particularly if you have any medical condition, are taking medication, or are pregnant. You participate in any training or nutrition program at your own risk. Individual results vary and are not guaranteed; outcomes depend on individual effort, adherence, genetics, and other factors outside our control.
Intellectual Property
All program materials, content, and resources provided by State of Alpha are our intellectual property and are licensed to you for your personal, non-commercial use only. You may not republish, resell, redistribute, reproduce, or share program materials with any third party.
Confidentiality
Information you share with us in the course of coaching will be handled in accordance with our Privacy Policy. You agree to keep confidential any proprietary methods or materials we provide.
Limitation of Liability
To the maximum extent permitted by applicable law, State of Alpha shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded under applicable law.

Changes to These Terms
